AMERICAN EXPRESS® MERCHANT MINUTE
CONTEST RULES AND REGULATIONS
NO PURCHASE NECESSARY TO ENTER OR CLAIM PRIZE. OFFERED ONLY IN CANADA AND OPEN ONLY TO CANADIAN MERCHANTS WHO ACCEPT THE AMERICAN EXPRESS® CARD.

- During the contest period, March 10, 2003 to April 30, 2003, inclusive, simply complete the survey enclosed in the Spring 2003 Merchant Minute or the online survey at www.americanexpress.ca/merchantminute and follow the instructions outlined ensuring that you indicate your merchant number. The person designated, as the contact name will be automatically entered. All online entries must be received by 11:59 p.m. (EDT) on April 30, 2003, the contest closing date. Limit of one entry per merchant number.
- There will be one (1) prize awarded consisting of a $2,000 (CAD) American Express® Gift Cheque. Prize must be accepted as awarded.
- A random selection will be made in Saint John, N.B, at 2:00 p.m. (ADT) on June 3, 2003, from among all eligible entries received on or before the contest closing date. In order to win, the selected entrant must first correctly answer, unaided, a time-limited, arithmetical, skill-testing question to be administered by telephone at a mutually convenient time. If the selected entrant cannot be contacted in a timely fashion or if, for any reason, the prize cannot be awarded, another contest entry will be randomly selected and so on until the prize has been awarded. Odds of being selected depend on total number of eligible entries received.
- Winner agrees to the use of his/her name and/or photograph, as well as the merchant name, for advertising, publicity and promotional purposes in all media, including but not limited to within www.americanexpress.ca without compensation and agrees to execute specific consent to such use if asked to do so. By entering, contestants agree to abide by the contest rules and the decisions of the independent contest organization, which are final.
- To enter and be eligible to win, an entrant must be a resident of Canada, an existing Canadian merchant who accepts the American Express Card and who has reached the age of majority in their province or territory of residence on or before March 10, 2003, and not an employee of, a member of the immediate family of or domiciled with an employee of Amex Bank of Canada, Amex Canada Inc., the independent contest organization and their respective subsidiaries, affiliates, advertising or promotional agencies, agents and representatives.
- By participating, entrants agree to release, discharge and hold harmless Amex Bank of Canada, Amex Canada Inc., their respective employees, officers, directors, parent, affiliates, subsidiaries, advertising and promotion agencies, agents and representatives from any and all injuries, liability, losses and damages of any kind resulting from their participation in the contest or their acceptance, use or misuse of the prize. Amex Bank of Canada, Amex Canada Inc., their respective officers, directors, parent, affiliates, subsidiaries, advertising and promotion agencies, agents and representatives and their respective employees are not responsible for and shall not be liable for (a) any electronic, hardware or software program, network, Internet or computer malfunctions, failures or difficulties of any kind, including without limitation, server malfunction or any human error which may occur in the processing of entries; (b) failed, incomplete, garbled or delayed computer transmissions; (c) lost, late, misdirected, incomplete or incorrect entries; or (d) any condition caused by events beyond the control of Amex Bank of Canada that may cause the promotion to be disrupted or corrupted. Amex Bank of Canada reserves the right, in its sole discretion, to cancel or suspend the contest or any portion thereof should a virus, “bugs” or other causes beyond the control of Amex Bank of Canada corrupt the administration, security or proper play of the promotion. Entry information becomes the property of Amex Bank of Canada.
- Litigation from Québec residents respecting the conduct or organization of this publicity
contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any such litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Contest is subject to all applicable Federal, Provincial and Municipal laws.
